These Terms of Use ("Terms") govern your access to and use of https://www.flycre.com (the "Site"), operated by FlyCRE, a division of Burge Corporation ("FlyCRE," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Our services
FlyCRE provides aerial site documentation and data subscription services: scheduled aerial capture of RGB, thermal, and multispectral imagery, processed and delivered through the FlyCRE Intelligence platform as an observational record. Services are provided only under a separate written agreement, which controls if it conflicts with these Terms. Nothing on the Site is an offer to provide services on particular terms.
FlyCRE does not provide maintenance, repair, inspection, or land surveying services.
2. Measurements and survey limitations
FlyCRE deliverables are visual documentation with approximate measurements for condition tracking and reference. They are not land surveys, are not survey-grade, and are not prepared or certified by a California-licensed land surveyor. They are not intended for engineering design, construction layout, boundary or elevation determination, or quantity verification for payment. If a project requires survey-grade work, it will be provided by a licensed land surveyor under a separate agreement.
3. No professional advice
We document conditions. We do not make compliance, insurance, legal, engineering, or agronomic determinations. Fire authorities, insurers, attorneys, engineers, and other qualified professionals make those determinations. Content on the Site, including blog articles, is general information about regulations and practices as of its date. It is not legal, insurance, engineering, or compliance advice, it may not reflect later changes, and you should confirm current requirements with the responsible agency, carrier, or a qualified professional before acting on it.
4. Accuracy of Site content
We work to keep the Site accurate and cite our sources, but laws, rules, and programs change. We do not warrant that Site content is complete, current, or error-free, and we may change it at any time without notice.
5. Using the Site
You may use the Site for lawful purposes only. You agree not to:
- submit false or misleading information, or information about another person without authority;
- interfere with or disrupt the Site, its servers, or its security, or attempt to gain unauthorized access to any system, including FlyCRE Intelligence;
- scrape, harvest, or collect content or data from the Site by automated means for any commercial purpose, or use it to train machine learning models, without our written permission;
- copy, modify, or distribute Site content except as allowed in section 6;
- use the Site to transmit malware, spam, or unlawful content.
6. Intellectual property
The Site and its content, including text, graphics, imagery, logos, and the FlyCRE name and marks, are owned by FlyCRE or Burge Corporation or used with permission, and are protected by intellectual property laws. You may view and print pages for your own internal, noncommercial reference. Any other use requires our written permission. Client data captured under an agreement belongs to the client as that agreement provides.
7. FlyCRE Intelligence
Access to FlyCRE Intelligence is limited to authorized users of clients under a subscription agreement and is governed by that agreement. Do not share your credentials. Report any suspected unauthorized access or security concern to info@flycre.com.
8. Submissions
When you submit a form, you confirm that the information is accurate and that you are authorized to provide it. We handle personal information as described in our Privacy Policy. Do not send confidential information through the Site unless we have agreed in writing to receive it.
9. Third-party links
The Site links to government agencies, publications, and other sites we do not control. We are not responsible for their content, availability, or practices, and a link is not an endorsement.
10. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FLYCRE, BURGE CORPORATION, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. These limits do not apply to services provided under a written agreement, which are governed by that agreement, and do not limit liability that cannot be limited by law.
12. Indemnity
You agree to defend, indemnify, and hold harmless FlyCRE and Burge Corporation from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page and changing the effective date. Your continued use of the Site after an update means you accept the updated Terms.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and FlyCRE about the Site.
